Welcome to the World of Business & Investment Immigration

Welcome to my new blog to help you through the complicated world of business and investment immigration!

My name is Zoe Naylor, and I am the lead attorney for the Business and Investment Immigration cases at Bogart Immigration, PLLC. We are located in Fayetteville, AR, which is right at the Northwest corner of Arkansas, about 3 1/2 hours from Kansas City, and 5 hours from Dallas. If you are not local though, do not let that stop you from reading! The nice thing about immigration law, is that it is federal law, so we generally will have the same issues popping everywhere. And I am happy to assist any of you around the US (or the world!) through the beauty of technology.

This blog is intended to address recent news, specifically about business and immigration trends or updates, but may also look at general immigration news and questions as well. I give a monthly business immigration live video on the second Thursday of the month at 8pm here so this site will help supplement those times when I am not right in front of the camera. We will post my updates on our facebook, and you should be able to find something new here every week! Follow us on facebook for even more news updates, and to view attorney videos for all the attorneys at our firm (live Thursdays at 8pm).

While my focus is business and investment immigration, our firm deals with all aspects of immigration. Shaughan Sparks Cummings handles our humanitarian cases, Nathan Bogart handles our litigation and family immigration cases, and Charlcee Small handles our criminal cases. I have handled immigration cases since 2013, and am passionate about helping those who want to find both non-immigrant, and immigration paths to come to the United States. As a foreigner myself, I emigrated to the United States from Australia when I was in high school, and had to figure out the complex immigration system personally, as went through the citizenship process. Now as a dual citizen, I wish to help others find their American dream. Come with me on this journey, and if you need help along the way, give us a call at Bogart Immigration. 479-957-9819

What is Investment Immigration?

What is investment immigration?! What falls under this category?! Generally, investment immigration is going to be what it sounds like - you are a foreigner who wants to invest in the United States!  These typically have to be high investment amounts. You must be able to invest $1,000.000 (USD), or $500,000 (USD) in a high-unemployment, or rural area.  Then within 2 years, you must be able to create 10 full-time jobs for those authorized to work (US citizens, or immigrants with permission).  These people cannot include yourself, your spouse, or your kids though. This visa falls under the EB-5 category of immigration business visas, which means that this is a path to obtaining legal permanent residence in the United States. These visas may seem easy on their face - just be super wealthy with a good business idea! However, they are one of the more tricky and complicated visas because of the various requirements around the type of business (sole proprietorship, partnership etc), th

What is Business Immigration?!

You may be wondering, what is business immigration? What does that term even mean?!  In general, business immigration is going to encompass any form of immigration where an employer, job position, or specialized skill is the reason for the visa application.  This would be in opposition to something like family immigration, where you might be sponsored by  a family member; or humanitarian immigration, where you might be applying based on your country circumstances or some qualifying event.  You may have the opportunity to look at multiple paths to an immigrant status, and one of these paths does not necessarily prevent you from applying for another visa form. However, for business immigration, you must meet specific business visa requirements to even have this as an option. Within business immigration, we can typically group business visas into two groups: immigration visas, where there is a path to a lawful permanent residence status (ie a greencard); and non-immigrant visas, wher
